These Terms of Use reflect the way that ORCHA's business works, the laws that apply to our company and the way in which we govern this digital health platform. These Terms of Use help to define ORCHA's relationship with the end user as they interact with our platform.

Use of the platform assumes acceptance of these terms.

In addition to these Terms of Use, we also publish a Privacy Policy which explains our approach to data management and the rights our users have,

Provider

These services are provided to AARP, a nonprofit, nonpartisan organization that helps people 50+ have independence, choice, and control in ways that are beneficial and affordable to them and society as a whole.

The services are provided by ORCHA Health Inc (ORCHA) and protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws applicable.

What you can expect from ORCHA

Use of this platform provides AARP members with access to a library of digital health and wellbeing apps that have been assessed by the ORCHA assessment team in compliance with the AARP Age-Friendly Assessment Framework.

ORCHA define digital health as "a digitally delivered product that is aimed at supporting in some way general health or specific conditions".

This includes 'wellness'-oriented apps where there is a clear health related focus and benefit.

Apps are assessed against the AARP Age-Friendly Assessment Framework, developed in collaboration with, and owned by, AARP ("AARP Assessment").

The core purpose of the site is to provide impartial information about an App's compliance with the Standards encompassed within this Framework and to enable Members to easily identify apps that best meet these Standards.

The content included in the website is not intended to be a substitute for professional medical care provided by a qualified doctor or other suitable healthcare professional. Members relying on content to inform medical decisions should always check with a Professional if they have any concern about their or someone else's health, condition or any treatment they or someone else may be taking or planning to take.

The AARP Assessment and Service

The AARP assessment provides a comprehensive overview of health and wellbeing apps, highlighting those that are designed to meet the needs of older adults and provide those that are less accessible or inclusive with clear direction on where incremental improvements can be made.

The Framework assesses four scored domains: Data and Privacy, Clinical Assurance and Safety, Usability and Cost.

This assessment is largely undertaken independently from the developer with a small amount of the assessment reliant on information provided by the App owner as evidence of compliance against the different sections and corresponding standards included within the Framework. Further details can be found on the assessment scheme below.

App Score

Upon completing the assessment each App is provided with an overall score indicating their level of compliance against the framework. The higher the score, the more compliant an App is with the Standards and vice versa. If an App scores 65% or more they will be surfaced on to the App Library. This score threshold has been set by and agreed with AARP.

While a higher scoring App is not guaranteed to be effective or safe, a poorly scoring App is not necessarily ineffective or unsafe. It does however provide indication of an App Owner's level of compliance with Key Standards which we believe to be an indication of best practice.

Inaccurate or misleading information

The AARP assessment includes assessing information provided by App developers, the App itself and/or available in the public domain via a connected website or the relevant 'app store'.

We are reliant on this information in undertaking our reviews and are not responsible for inaccuracies or errors in the information provided. App developers are governed in most jurisdictions by laws that require them to avoid misleading or inaccurate statements about their products.

What to do in the event of inaccuracies

Even where information provided is accurate, our Review cannot guarantee that an App will perform as promised in any specific circumstances or that the App is free now or in the future from any bugs or issues that might affect its performance. We accept no responsibility for any adverse effects of the App in question.

If you believe that any information provided via the review is inaccurate or misleading or you become aware of any inaccuracy in the information presented in our Reviews or have any other concerns, please report this to us immediately at hello@orchahealth.com for investigation.

Downloading an App and Data

The ORCHA site has been designed to enable users to click through to download the App. It should be noted that ORCHA does not have access to any User Data inputted directly into a third-party app made available via this website. There are no commercial arrangements in place whereby ORCHA or AARP receive funds for click throughs, page views or downloads of any apps accessed through this website.

Developing, improving and updating the ORCHA platform

We're constantly reviewing our site content to provide the best possible experience. Our assessment process has been designed to ensure that we continually review and monitor an app's compliance with the Standards as they update and upgrade. In this regard, we sometimes add or remove Apps depending on the resultant impact to their score.

In partnership with AARP we identify wellness categories and Apps to participate in the selection process giving consideration to the interests of AARP, its members and areas of priority and focus.

Intellectual Property

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively "Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel" and arrangement of such Content, contained on the site is owned, controlled or licensed by or to AARP and is protected by trade dress, patent and trademark laws, and various other intellectual property rights and unfair competition laws.

Except as expressly provided in these Terms of Use, no part of the Site, and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring") to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without AARP and ORCHA express prior written consent.

Any extracts from the website that are reproduced for non-commercial purposes should be supported by a full acknowledgement and references to AARP and ORCHA.

The publishing of hyperlinks to external websites is for information and reference purposes. It does not imply any approval of their contents or commercial affiliation. AARP and ORCHA are not responsible for the accuracy, timelines or relevance of such linked websites.

You may not use this website for unlawful purposes, in any way that breaches Applicable law or regulation. You may not use our content fraudulently or for the purposes of generating unsolicited spam emails or computer viruses. These Terms and Conditions are governed by US law. We reserve the right to change our Terms and Conditions at any time, as they are updated to meet changing needs and any new legislation.
